+Understanding the Probate Court

The Legal View's guest in this episode is Houston County, Alabama Probate Judge Luke Cooley who has been a Probate Judge for 16 years to tell the viewers about the probate system and what she does in work as a Probate Judge. The department does more than the probate of wills. One of the more fun things they do is adoptions both child and adult. The role of the attorney in probate proceedings is discussed as well as the role of attorneys in keeping estates out of probate entirely. Probate Judges also handle guardianships and conservatorships that are discussed in this episode. Another major function of the Probate Court in Alabama is mental health issues that require court intervention that can include psychiatric hospital placement or outpatient treatment. The last major function of the probate court discussed is the supervision of elections. The next episode will have as a special guest Carla Woodall, Houston County, Circuit Clerk.

+Alabama's Houston County Clerk

The Legal View's guest in Episode #3 is Alabama's Houston County Clerk, Carla Woodall who is an elected official. Her office is charged with maintaining all the court files with a staff of 20. They handle all of the money of the court in and out of the court. They also process all the subpoenas issued and jury summons. There are nine divisions in the County Clerk office. The lower Alabama area has a tremendous amount of cases thus Houston County is a busy court system. The divisions of the courts are discussed and which court a case would go to in the system. The importance of jury trials and how jurors are found for the court is discussed. What happens to you while you are at jury duty is explained as well.
