Dothan Alabama Truck Wreck Lawyer Settles Claim

Dothan Alabama Personal Injury and Accident Lawyer Aaron Gartlan of the Gartlan Injury Law settled a claim without filing a lawsuit with Lincoln General Insurance Company on behalf of Alabama Motor Express for a good hard working self- employed Alabama man that was injured in a truck wreck involving a commercial driver.

The police report clearly revealed that the driver of the AMX truck was negligent and crashed into the rear end of the Alabama Man’s vehicle as he was attempting to change lanes on U.S. Highway 231. Accordingly, liability clearly rested solely with the truck driver.

Thankfully, the Alabama Man’s injuries were relatively minor under the circumstances compared to some of the Gartlan Injury Law’s other personal injury and accident cases. However, this is due in large part to the Alabama man’s desire to not let the wreck hinder his life and because of his strong work ethic. His major complaints were headaches, soreness and numbness. As a result of this crash, he suffered soreness, numbness, achiness inter scapulary, discomfort over his left triceps and numbness and tingling in both fingers, severe cervical torticollis, arterial spasm and ringing in both ears. For a time, he could not move his neck at all. Then, it became semi-rigid, and he experienced muscle spasms. He continued to have persistent symptoms including: stiffness in the neck, pain in the bilateral mid back, dull headaches, numbness in both arms, mild pain in the shoulder and tenderness in the cervical region. This hindered his ability to work for about a month.

He was seen by a doctor at the local hospital for achiness inter scapulary, discomfort over his left triceps and numbness and tingling in both fingers. He was prescribed Mepergan Fortis, Valium and instructed to take Aleve for pain and x-rays were ordered. Later, her followed up with the doctor and was experiencing severe cervical torticollis, bitemporal headaches from arterial spasm and ringing in both ears. He could not move his neck at all. The doctor put him in a neck collar and TEM patches and ordered a MRI. After a few days he went to the doctor again and was doing better. His neck was still semi-rigid, and he was still experiencing muscle spasm. The doctor felt that he needed to take it easy and not return to work. On another follow-up visit, he saw the doctor and his condition had improved some. The doctor instructed him to continue to take Aleve for inflammation.

The Alabama man saw the chiropractor for persistent symptoms including: stiffness in the neck, pain in the bilateral mid back, dull head-aches and numbness in both arms. The chiropractor determined that he was experiencing mild pain in the shoulder and tenderness in the cervical region. The chiropractor gave the following diagnosis: subluxation, (cervical), cervical sprain/strain; headache; cervicalgia; subluxation (thoracic); thoracic pain; thoracic sprain/strain. The chiropractor advised him on a treatment program and to get extra rest and to use a cold pack. He followed-up with the chiropractor later and reported stiffness in the neck, pain in the bilateral mid back, dull headaches and numbness in both arms. He saw the chiropractor again and reported that the neck pain and headaches and numbness had improved, but he was still experiencing stiffness in the neck and back pain. On these dates, the chiropractor treated him and advised him to use a cold pack and get extra rest.

When he came to see Aaron Gartlan and the Law Firm, he was not sure how to handle the case and deal with the insurance companies and outstanding bills. Again, the claim was settled with Lincoln General Insurance Company on behalf of Alabama Motor Express without filing suit. The Law Firm took control of communicating with the insurance companies and medical providers. They obtained all of the medical records and bills and important documents and made a demand on the insurance company which summarized the injuries and damages.
