Personal injury and accident lawyers often hear, “Do I have an open and shut case?” or “I have an open and shut case.” In the realm of personal injury, accident, and wrongful death cases, there is really no such thing as an open and shut case. The civil justice system is full of legal and procedural requirements that have to be met, and there are defenses that, often times, have to be overcome. So in reality, if you have a case where you have significant injury and damages, then it is not an open and shut case. Therefore, it is vital to retain the services of an experienced personal injury and accident law firm, as soon as possible, after an accident and injury.
